Key Elements of a Discrimination Claim
To file an employment discrimination claim, you must first show that you belong to a protected class — meaning a minority group that is protected by civil rights law. Additionally, the discrimination must have occurred because of your membership in the protected class. California enjoys a wider range of protections than most states, but you still cannot claim discrimination unless you suffered negative effects directly related to your status as a protected minority. For example, under the Age Discrimination in Employment Act (ADEA), only people age 40 and older may claim discrimination based on age.
In California, protected categories include:
- Race, color, and national origin
- Sex, including pregnancy status, sexual orientation, and gender identity
- Age
- Religious and political beliefs
- Marital status
- Disabilities, medical conditions, and genetic information
- Citizenship status or activities (such as jury duty)
